1 - DEFINITIONS

Terms used in the Terms shall have the meanings set forth below:

Buyer : natural person acquiring Products through the Site.

Order : purchase order of the Buyer for one or more Products accepted by the Seller in accordance with the Terms and Conditions.

Cookie : an application sent by a World Wide Web server to a user, sometimes without the user's knowledge, during a connection in order to characterize that user. By extension, information that the applet can save on the user's disk and that the server can access later.

Email : A computerized document that a user enters, sends or views offline over a network.

Internet : A global network of telecommunications resources and server and client computers for the exchange of electronic messages, multimedia information and files. It operates using a common protocol that allows messages cut into independent packets to be routed from one location to another.

Party(ies) : The Buyer and/or the Seller

Product : property offered for sale on the Site by the Seller

2 - PURPOSE

The purpose of the Conditions is to define the rights and obligations of JALAN JALAN and the Buyer in the context of the sale of the Products through the site.

 

 3 - SCOPE OF APPLICATION

The Conditions apply to all sales of Products by JALAN JALAN to the Buyer, made through the site.

An Order will be taken into account by JALAN JALAN only after prior acceptance of the Conditions by the Buyer.

 

 4 - ORDER

The Purchaser places his/her Order through the Site.

All contractual information is presented in French and English.

This information will be the subject of a confirmation at the latest at the time of delivery.

The Purchaser declares having read the Terms and Conditions prior to placing his/her Order and acknowledges that the validation of his/her Order implies the acceptance of their terms.

The Purchaser further acknowledges that the Conditions are made available to it in a manner that allows their conservation and reproduction, in accordance with Article 1369-4 of the French Civil Code.

The offers presented by JALAN JALAN are valid as long as they appear on the site and within the limit of available stocks.

In order to place the Order, the Purchaser must provide JALAN JALAN with data concerning him/her and fill in an online form accessible from the Site.

The sales contract between JALAN JALAN and the Purchaser is formed when the Purchaser clicks on the "Validate" button when confirming his/her Order.

Until this final step, the Purchaser will have the possibility to return to the previous pages and to correct and modify his/her Order and the information previously provided.

A confirmation e-mail, acknowledging receipt of the Order and containing all of this information, will then be sent to the Purchaser as soon as possible.

The Purchaser must therefore provide a valid e-mail address when filling in the fields relating to his/her identity.

In the event that a Product ordered by the Purchaser is unavailable, JALAN JALAN undertakes to inform the Purchaser by E-mail as soon as it is aware of this unavailability. However, information on the availability of the items is provided at the time of the order.

 

 5 - PAYMENT

The prices of the Products indicated on the pages of the Site correspond to the prices in euros, including all taxes and excluding participation in the costs of logistical preparation and shipping.

The Seller reserves the right to modify the prices of the Products presented on the Site.

However, the Products will be invoiced to the Purchaser on the basis of the prices in force at the time of validation of the Order.

Payment for the Order shall be made :

By credit card :

Payment is made on a secure area of SOCIETE GENERALE. The security of the transport of the card data is ensured by a 128-bit SSL (Secure Socket Layer) encryption and the payment page is hosted on a bank server that ensures the integrity and confidentiality of the data collected.

The credit card will be debited at the time of validation of the payment. The order will then be prepared.

The payment order made by credit card cannot be cancelled. Consequently, the payment of the Order by the Purchaser is irrevocable, without prejudice to the Purchaser's right to exercise his right of withdrawal or subsequent cancellation of the Order.

By PayPal :

Payment will be made via the Buyer's PayPal account. The Order will be prepared upon receipt of the notice of payment sent by PayPal.

The transfer of ownership of the Product to the Buyer will only take place at the time of the complete collection of the price by the Seller.

In several installments with Alma :

Payment in several times with Alma.
If you pay your order in several times, you accept the general customer conditions of Alma. as well as the special Alma conditions for JALAN JALAN customers.

By bank transfer :

Upon validation, the Buyer receives an order form confirming the registration of his order. In order to finalize his payment and trigger the processing of his order, the Purchaser must contact his bank to make the transfer corresponding to the amount of his order to the bank account of JALAN JALAN, whose coordinates are communicated to the customer. (IBAN: FR76 30003033200002091473655 - BIC code: SOGEFRPP). Upon receipt of the transfer, the order will be processed and the buyer will be informed by email. The seller will then dispatch the order.

 

 6 - DELIVERY

The Product will be delivered to the coordinates indicated by the Purchaser in the form filled out at the time of the Order.

Delivery cannot be made to hotels or post office boxes.

Once the order has been confirmed, it will no longer be possible for the Buyer to change the delivery address.

JALAN JALAN undertakes to deliver the product subject of the Order within a maximum period of thirty days from the day following the validation of the Order.

If the Seller exceeds this time limit for shipping the Product, an e-mail will be sent to the Buyer and the Buyer will have the possibility to cancel the Order; and, if his bank account has already been debited, to be reimbursed the price of the Product within 30 days.

The return of the Product and the reimbursement of the Purchaser will take place under the conditions provided for below in Article 7 "Cancellation - Withdrawal - Reimbursement".

Shipments are made by COLISSIMO SUIVI or MONDIAL RELAY according to the Purchaser's choice.

COLISSIMO DOMICILE : Delivery to the address of your choice. Indicative delivery time of 48 hours. Delivery against signature, tracking number and insurance included

COLISSIMO POINT RETRAIT : Delivery in the relay point of your choice. Indicative delivery time of 48 hours. Tracking number and insurance included.

MONDIAL RELAY : Delivery in the relay point of your choice. Indicative delivery times of 3 working days from the time the package is picked up

Delivery times related to the Post Office or any other carrier are not the responsibility of JALAN JALAN. The purchaser is obliged to check the state of the packaging and, if necessary, to express reserves on the delivery note of the carrier or to refuse the delivery so that JALAN JALAN can turn against the Post Office in case of dispute.

JALAN JALAN controls for its part all packages at the time of shipment.

 

7 - CANCELLATION - RETRACTION - REIMBURSEMENT

As of the reception of the Product by the Buyer, the latter has a 14-day retraction period, allowing him/her, without having to justify particular reasons, to return the delivered Product*.

If the Purchaser makes use of this right of withdrawal within 14 clear days from receipt of the Product, JALAN JALAN undertakes to reimburse the Purchaser for all sums paid without delay and at the latest within thirty days from the date on which this right was exercised. *

Return postage will be charged to the Buyer.

Items returned incomplete, damaged, deteriorated by the customer will not be refunded. Items must be returned in their original packaging with the cleansing cloth offered with the order. In case of non-return of this cleansing cloth, it will be charged and deducted from the refund at the selling price on our site, that is 7€.

 

To exercise these rights of cancellation of the Order and retraction, the Purchaser must go to the Site under the heading "contact" to ask for return OR fill in the online form here to inform JALAN JALAN and request a return authorization.

A confirmation acknowledging receipt of this return request will be sent to him/her by e-mail.

Rings or bracelets that have been sized or adjusted at the request of the Buyer will be the subject of a credit note and not a refund. This credit note will be valid for an unlimited period on the entire site.

 

 8 - GUARANTEE

If the Product received by the Purchaser does not conform to the Product designated in his/her Order, this Product will be replaced or reimbursed, depending on the Purchaser's expressed wish.

In the event that the item received by the Purchaser does not conform to the item designated within his Order, the Purchaser shall report this upon receipt of his order. This item will then be replaced or repaired, according to the wish expressed by the Purchaser, unless this wish entails a cost that is clearly disproportionate to the other modality.

 

If the wish expressed by the purchaser cannot be executed within one month following his complaint, or if this repair or replacement is impossible, the purchaser will have the option of returning the article and having the price of this article refunded if payment has already been made.

In addition, without prejudice to his rights of withdrawal, cancellation and guarantee of conformity mentioned above, the purchaser benefits on the product of the guarantee of hidden defects as provided for in articles 1641 to 1649 of the Civil Code. These guarantees are free of charge for the buyer.

9 - LIABILITY

JALAN JALAN is responsible by right towards the Buyer for the proper execution of the Order.

However, the responsibility of JALAN JALAN cannot be engaged if it proves the non-performance or poor performance of its obligations is attributable to the Purchaser, to the unforeseeable and insurmountable fact of a third party not involved in the provision of the services provided for in the Conditions, or to a case of force majeure.

JALAN JALAN cannot be held liable for damages resulting from a fault of the Purchaser in the use of the Products.

 

 10 - INTELLECTUAL PROPERTY

All the elements published within the Site, such as sounds, images, photographs, videos, writings, animations, programs, graphic charter, utilities, databases, software, are protected by the provisions of the Code of the intellectual property and belong to JALAN JALAN.

The Buyer is prohibited from infringing on the intellectual property rights relating to these elements and in particular from reproducing, representing, modifying, adapting, translating, extracting and/or reusing a qualitatively or quantitatively substantial part of them, with the exception of acts necessary for their normal and compliant use.

JALAN JALAN prohibits any hypertext link to the Site without prior agreement.

 

11 - PERSONAL DATA

The Purchaser is informed that, during his/her navigation and within the framework of the Order, personal data concerning him/her are collected and processed by JALAN JALAN as the person in charge of processing, in particular through the online form intended to place the Order.

The Purchaser is informed that the Order cannot be placed if this form is not correctly filled in.

This form contains an indication of the optional or mandatory nature of the fields to be filled in.

JALAN JALAN will be the recipient of the data thus collected.

This processing is the subject of a declaration to the Commission Nationale Informatique et Libertés (National Commission for Information Technology and Civil Liberties) in application of the law n°78-17 of January 6, 1978.

This data is used to process the Order and to improve and personalize the services offered by the Seller.

They are not intended to be transmitted to third parties.

The Purchaser is informed that JALAN JALAN wishes to install a Cookie in his/her computer in order to record information relating to the Purchaser's browsing on the Site, information intended to be kept for a period of 10 years.

The implantation of a Cookie is intended to record information so that it can be read during the Purchaser's next visits to the Site.

However, the Purchaser has the right to oppose the recording of Cookies on his/her computer and must then proceed as follows:

The Purchaser has the right to oppose, for legitimate reasons, the processing of personal data concerning him/her.

He has the right to oppose, free of charge, that the data concerning him be used for prospecting purposes, in particular for commercial purposes, by the Seller or by the person responsible for further processing.

The Buyer, if he proves his identity, has the right to question JALAN JALAN in order to obtain confirmation that personal data concerning him are or are not subject to such processing, information about the purposes of the processing, the categories of personal data processed and the recipients or categories of recipients to whom the data are communicated, if any, information on the envisaged transfers of personal data to a State which is not a member of the European Community, the communication, in an accessible form, of the personal data concerning him/her and of any available information as to their origin, information making it possible to know and challenge the logic underlying the automatic processing in the event of a decision taken on the basis thereof and producing legal effects with regard to the person concerned.

The Purchaser is informed that a copy of the personal data may be provided at his/her request.

 The Buyer, if he proves his identity, also has the right to demand from JALAN JALAN to rectify, complete, update, lock or erase any personal data concerning him that is inaccurate, incomplete, ambiguous, outdated, or whose collection, use, communication or storage is prohibited.

In order to exercise this right, the Buyer will send a letter to JALAN JALAN in its capacity as data controller, at the following address

When requested by the Buyer, JALAN JALAN must prove, at no cost to the Buyer, that it has carried out the required operations.

The Buyer is informed that in case of a dispute the burden of proof lies with JALAN JALAN, except when it is established that the disputed data were provided by the Buyer or with his consent.

The Buyer is also informed that, in the event of a change in the registration, the Buyer is entitled to reimbursement of the costs of the aforementioned copy.

 

12 - AGREEMENT ON PROOF

It is expressly agreed that the Parties may communicate with each other by electronic means for the purposes of the Terms and Conditions, provided that technical security measures to ensure the confidentiality of the data exchanged are put in place.

Both Parties agree that the E-mails exchanged between them validly prove the content of their exchanges and, where applicable, of their commitments, in particular with regard to the transmission and acceptance of Orders.

 

 13 - PARTIAL INVALIDITY

If one or more of the provisions of the Terms and Conditions are found to be unlawful or invalid, such invalidity shall not invalidate the remaining provisions of these Terms and Conditions, unless such provisions are inseparable from the invalidated provision.

 

 14 - APPLICABLE LAW

The Conditions are governed by French law.

 

 15 - ATTRIBUTION OF COMPETENCE

The Parties agree that in the event of any dispute that may arise concerning the execution or interpretation of the Conditions, they will endeavour to find an amicable solution.

If this attempt at amicable resolution fails, the dispute will be brought before the competent courts.
